Welcome to Bar Charts Australia. These Terms and Conditions govern your use of our website at barchart and the purchase of custom bar chart design, printing, and related services. By accessing our site or placing an order, you agree to be bound by these terms.

1. General Terms

  • Eligibility: You must be at least 18 years old or have legal authority to enter into contracts.
  • Accuracy of Information: You are responsible for providing accurate, complete, and current information during ordering and account registration.
  • Changes to Terms: We reserve the right to modify these terms at any time. Updates will be posted here with the revised "Last updated" date. Continued use after changes means acceptance.

2. Services Offered

We provide:

  • Custom bar chart design from your data (CSV, Excel, PDF, etc.)
  • High-quality digital and physical printing
  • Express delivery options across Australia
  • File preparation and data visualization consulting

All services are subject to availability and final confirmation.

3. Ordering Process

  • Order Placement: Orders are placed via our online system. A confirmation email will be sent upon successful submission.
  • Acceptance: We reserve the right to accept or reject any order. Acceptance occurs when we send an order confirmation and begin processing.
  • Pricing: All prices are in Australian Dollars (AUD) and include GST where applicable. Prices may change without notice but will not affect confirmed orders.
  • Payment: Full payment is required at checkout via secure third-party gateways (Stripe, PayPal). We do not store card details.

4. Intellectual Property

  • Your Data: You retain ownership of all data and files you upload.
  • License Granted: By uploading data, you grant us a non-exclusive, royalty-free license to use, modify, and reproduce it solely to fulfill your order.
  • Our Designs: Final bar chart designs (excluding your raw data) are owned by Bar Charts Australia unless a full copyright transfer is purchased separately.
  • Trademarks: "Bar Charts Australia" and our logo are registered trademarks. Unauthorized use is prohibited.

5. Delivery and Shipping

  • Digital Files: Delivered via email or downloadable link within 1–3 business days (standard) or 4–8 hours (express).
  • Physical Prints: Shipped via Australia Post or courier. Delivery times:
    • Standard: 3–7 business days
    • Express: 1–2 business days
  • Shipping Costs: Calculated at checkout based on size, weight, and location.
  • Risk of Loss: Risk passes to you upon delivery to the shipping carrier.
  • Delays: We are not liable for delays due to incorrect addresses, customs, or events beyond our control.

6. Refunds and Cancellations

  • Cancellations: Orders can be cancelled within 1 hour of placement for a full refund. After design begins, a 50% fee applies.
  • Refunds:
    • Faulty or incorrect prints: Full refund or reprint at no cost.
    • Change of mind: Not accepted for custom-made products.
    • Digital products: Non-refundable once delivered.
  • Refund Processing: Issued to the original payment method within 7 business days.

7. Quality Guarantee

We guarantee:

  • Prints match approved digital proofs
  • Colors are accurate within industry tolerances (±5% variance)
  • Materials meet stated specifications

If standards are not met, contact us within 7 days of receipt with photos for review.

8. Limitations of Liability

  • We are not liable for indirect, incidental, or consequential damages.
  • Our total liability shall not exceed the amount paid for the specific order.
  • We are not responsible for errors in data provided by you.

9. User Responsibilities

You agree not to:

  • Upload malicious, illegal, or copyrighted content without permission
  • Use our services for unlawful purposes
  • Attempt to hack, disrupt, or overload our systems

10. Force Majeure

We are not liable for failure to perform due to events beyond our control, including natural disasters, war, pandemics, or supply chain disruptions.

11. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of Sydney.
